1. Application of these Terms of Use
By clicking “I agree” or otherwise by using the website or any of our related websites (including the Gotcha4Life 24 Hour Row, Gotcha4Life 9 Hour Row and the Gotcha4Life Cup) or by purchasing and/or using of any products provided by us to you, each visitor (you, your) agrees to be bound by these terms of use (Terms of Use). Please read them carefully. There may be additional terms applicable to you depending on the service or goods.
We may vary these Terms of Use from time to time and we will publish the varied terms on the website. It is your responsibility to check the website periodically for changes and your continued use of the website following any changes indicates your acceptance of the changes. The date of the policy’s latest revision will be published on this page.

We welcome all visitors to the website (subject to you meeting the eligibility requirements set out above).You can browse the website and access and use the tools and resources available on the website. However, when you make a donation, whether one-time or regular, an account will automatically be created for you.
You are responsible for maintaining the confidentiality of your password and registration attached to your account and are fully responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorised use of your account or any other breach of security.
You can manage certain account settings at any time via your account dashboard. This includes:
updating your name and email address;
resetting your password;
making changes to your donation amounts (including cancelling, changing the amount/s, and/or updating the relevant payment details); and
obtaining copies of your donation receipts.
If you wish to delete your account, you must email us at supporters@gotcha4life.org to request this, as account deletion cannot be actioned through your account dashboard.
You warrant all your information is current, complete, and accurate. You agree to promptly update your account if your information changes.
4. Privacy and data
Your use of this website may involve the transmission to us of certain personal information (as that term is commonly defined under privacy laws and regulations). Our policies with respect to the collection and use of such personal information are governed according to our Privacy Policy (that you can access here).
We may collect anonymised data and data analytics to help us improve the website.

your use of, and access to, such Third Party Products may be subject to additional fees and separate terms issued by the supplier of such Third Party Products (Third Party Supplier), which will form a separate agreement between you and the relevant Third Party Supplier;
we make no representations or warranties in relation to, and do not accept liability for, any such Third Party Products; and
we may suspend your use of, or access to, the Third Party Products at any time, including on request from the Third Party Supplier.

Your use of our website and products and services is entirely at your own risk. None of the information and/or materials provided through our website and/or our products and services, or otherwise by us, is in the nature of advice. Information and/or materials provided through the products and services is general in nature.
We do not provide warranties of any kind in relation to the website, our products and services. To the fullest extent permitted by law, and except where otherwise set out in these Terms of Use:
we expressly disclaim all warranties, express or implied, of any kind with respect to the website and the products and services, including without limitation that the website will be uninterrupted or error-free or with regard to the results that may be obtained from the use of the website, or use of the information, content, service, or products provided through the website; and

Purchase and use of products
12. Payment
You acknowledge and agree:
all amounts shown at checkout are inclusive of all applicable taxes and are listed in AUD unless stated otherwise;
delivery costs are charged in addition to the price and will be clearly displayed and included in the ‘total’ at checkout;
discounts are offered at our discretion and any conditions applicable to the discounts will be specified prior to, or at the time of, payment; and
we try and ensure that all details, descriptions and prices on the website are accurate, however we are not liable for any errors that may occur. If we discover an error in the price or payment of the products you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it and receiving a refund. If we are unable to contact you, we will treat the order as cancelled.
Payment for all products must be by credit, Pay Pal or any other payment method listed on the checkout page of the website. All online debit/credit card transactions performed on the website are through secured payment gateways. All payment information is collected and stored by the third-party operators of the secured payment gateways, to be processed as required. We never permanently store complete debit/credit card details.
You acknowledge we will perform standard security checks on the payment details you provide. In the event of unusual activity, we reserve the right to temporarily or permanently suspend payment. We may contact you, your bank or any other relevant third party to report such unusual activity.
13. Delivery
We aim to deliver products to you at the place of delivery requested by you within the time indicated by us at the time of your order, but we cannot guarantee firm delivery dates.
Delivery times may vary, and we take no responsibility for delays caused by third party delivery services, strike, fire, flood, failure of suppliers, or any other circumstances beyond our reasonable control.
Will not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.
We offer shipping Australia-wide. The shipping cost will vary depending on your location. If, for any reason, we are unable to deliver to certain locations, we will inform you using the contact details that you provide to us when you place your order and arrange for cancellation of the order or delivery to an alternative address.
14. Cancellation, return and exchange
If you wish to cancel your order, please contact us at info@gotcha4life.org and we will consider (but are not obliged to accept) your request. Please note that once a product has been processed and shipped it cannot be cancelled if you change your mind.
You may return or request a refund for products supplied by us by emailing info@gotcha4life.org within 30 days of receiving your order. Your email must include your name, address, order number and the reason for the return. For faulty products, you must notify us within 14 days of receiving your order and provide your order number, a description of the fault, and supporting photographic evidence (Return Products). Once your return is accepted, in writing, you will be required to return the products to us at:

The Return Products must be returned in their original saleable condition, unwashed, unworn and with tags attached.
Notwithstanding any other provision to the contrary in these Terms of Use, certain products, such as those marked as final sale, will not be accepted for return for credit voucher or refund and will be returned to your original order address, except where any such products are faulty (in which case they can be returned or exchanged).
Return postage is the customer’s responsibility, as we do not provide return satchels. The Return Products, except for when they are faulty and/or incorrect due to our fault, must be returned at your expense to the return address specified above. We will not be responsible for any return packages sent to us other than by trackable mail or freight method, and we recommend using registered post. Where Return Products are faulty and/or incorrect due to our fault, we will reimburse your reasonable return postage costs upon receipt of proof of payment.
If the relevant return conditions are met, we will refund you for the amount you originally paid for the Return Products (excluding shipping fees, which we will only reimburse if the Return Products are faulty and/or incorrect due to our fault) within 10 business days from the date we receive the Return Products back from you. Please allow up to 10 business days for the refund of monies to your account.
We will provide a refund, repair, or replacement where we are required to do so by law. You may contact us at info@gotcha4life.org with any requests. Where you contact us regarding a refund or replacement, we reserve the right to request photographs or other reasonable evidence from you of, or in relation to, any products in question.
Subject to our obligations at law, in the following circumstances products will be treated as being "non-returnable":
where the products have been at your request personalised; and
where products which by their nature for hygienic reasons (e.g. products which have been worn, washed, and used).
15. Risk and title
Risk of damage to the products passes to you upon delivery at your specified delivery address.
Ownership of the products will pass to you when we receive full legally valid payment of all sums due in respect of the products, including delivery charges.
16. General
(a) Nothing in these Terms of Use will be taken as giving rise to a relationship of employment, agency, partnership or joint venture.
(b) These Terms of Use contain the entire understanding between you and us concerning the subject matter of the agreement and supersedes all prior communications.
(c) Any failure by us at any time to enforce these Terms of Use or any rights will not be a waiver of such rights or affect the validity of these Terms of Use.
(d) If any provision of these Terms of Use is held by a court to be illegal, invalid or unenforceable under the applicable law, that term or provision will be severed from these Terms of Use and the remaining terms and conditions will be unaffected.
(e) These Terms of Use are governed by, and construed in accordance with, the laws of New South Wales, Australia and the courts of the jurisdiction will have exclusive jurisdiction over any dispute arising out of these Terms of Use.
